Terms and Conditions for Custom-Made Jewellery Orders

1. Acceptance of Terms

By placing an order for a custom-made jewellery piece with Jewels of the Kimberley, you agree to the following terms and conditions. Please read them carefully before proceeding with your purchase.

2. Order Confirmation and Deposit

  • Design Approval: Once the design and specifications of your custom piece are finalised, we require your written approval to proceed.

  • Deposit: A non-refundable deposit of 50% of the total quoted price is required to commence production. This deposit confirms your commitment and allows us to begin the creation process.

3. Production and Modifications

  • Commencement: Upon receipt of the deposit, production of your custom jewellery will begin immediately.

  • Design Changes: Any requests for modifications after the deposit has been paid will be considered at our discretion. Additional costs and extended timelines may apply.

4. Cancellation Policy

  • Before Production: If you wish to cancel your order before production has commenced, please contact us immediately. The deposit remains non-refundable.

  • After Production Begins: Cancellations are not accepted once production has started. You will be responsible for the full payment of the agreed price.

5. Final Payment and Collection

  • Balance Payment: The remaining balance is due upon completion of the piece and must be paid in full prior to collection or dispatch.

  • Collection/Delivery: Upon receipt of the final payment, we will arrange for you to collect your jewellery or have it delivered as per our shipping policies.

6. Returns and Exchanges

  • Custom Orders: Due to the personalised nature of custom-made jewellery, returns or exchanges are not accepted unless the item is found to be defective or not as per the agreed specifications.

  • Defects: If you believe your piece is defective, please contact us within 7 days of receipt to discuss possible resolutions.

7. Use of Client-Supplied Materials

  • Assessment: If you provide gemstones or materials for your custom piece, we will assess their suitability.

  • Liability: While we handle all materials with the utmost care, we cannot be held responsible for any damage to client-supplied items during the creation process.

8. Intellectual Property

  • Design Rights: All designs, including those created in collaboration with clients, remain the intellectual property of Jewels of the Kimberley. Reproduction or replication without our express written consent is prohibited.

9. Warranty and Care

  • Warranty: We offer a 12-month warranty against manufacturing defects. This does not cover wear and tear, accidental damage, or misuse.

  • Care Instructions: Proper care will ensure the longevity of your jewellery. Please refer to our care guide or contact us for specific advice.

10. Governing Law

These terms and conditions are governed by the laws of Western Australia. Any disputes arising will be resolved in accordance with Australian law.
